The alternatives to unconditional sentence of imprisonment Abstract This thesis focuses on the alternatives to unconditional sentence of imprisonment. The introductory part includes chapters dealing with the concept of punishment, the concept of restorative justice and the activities of the Probation and Mediation Service. Furthermore, there are separate chapters in this part, which deal with the system of alternative measures, alternative sanctions, the development of alternative measures in legislation. In relation to the purpose of the work is mentioned briefly the issue of unconditional sentence of imprisonment. The main part of the thesis deals with selected alternative sanctions, namely conditional sentence, conditional sentence with supervision, house arrest, a sentence of community service, financial penalty and prohibition to enter the sport, cultural and other social events. The individual chapters deal in more detail with a specific alternative sanction in terms of its legal regulation and subsequent execution and implementation in practice. Both the advantages and disadvantages they face are discussed in detail and de lege ferenda addressed. key words: alternative measures, alternative sanction, restorative justice

Alternatives to unconditional sentence of imprisonment ABSTRACT This master's thesis deals with the topic of alternatives to unconditional sentence of imprisonment. The aim of the thesis is to evaluate advantages and disadvantages of alternatives to unconditional sentence of imprisonment, carry out a critical analysis of its legislation and provide own de lege ferenda proposals. Throughout the whole paper, comparative method is widely used. The Czech legislation is compared not only to the legislation of (central) European states, but to the legislation of the United Kingdom, Canada and the United States as well. The paper is divided into nine chapters in total. The first three chapters provide an excursion to the problematics of the term punishment and its purpose, alternative measures and (predominantly) critical analysis of unconditional sentence of imprisonment. Chapters four to seven analyse individual means of alternative sentences, i.e. house arrest, community service, fine and (supervised) conditional sentence of imprisonment. Each of these chapters is build up on the basis of a uniform model. Alternative measures of GDP

The findings of the research reveal that GDP has a number of important flaws and shortcomings, and thus fails to serve effectively for the purpose of measuring the economic growth of countries and welfare of their population as of today. Based on the evaluation of the advantages and drawbacks of macroeconomic measures alternative to GDP such as the United Nations Human Development Index, the Social Progress Index, the Environmental Performance Index, the Happy Planet Index, the Legatum Prosperity Index, the OECD Better Life Index, the World Happiness Index, etc., the author comes to a conclusion that despite the growing use of alternative measures, as of today, they are not able to replace GDP, but might complement it quite effectively.
The probation and its components in the Czech Justice

The probation {--} probare in Latin means to examine and verify. The probation can be understood as an alternative of unconditional sentence. Its principal is not only to protect society but also to re {--} educate criminals and to protect them againts harmful consequences of execution of confinement. The probation is one of the methods of treating criminals whereat both aspects penological and social are combined. It is not perceived only as summary of sanction precautions but also as a number of services, activities and operations which are provided by Probation and Mediation Services. The meaning of probation lies in more various access to a treating of criminals of different delicts, using other, more efficient means as a reaction to less serious criminality then confinement is and creating better conditions and ways of major crime sanctions. Criminals are spare from harmful effects which are connected with execution of confinement and they are not exposed to negative experiences with stay in prison.
